Eligibility
Open to Australian residents aged 18 years and over.
Employees of DuluxGroup, Bunnings and associated agencies (and their immediate families) are ineligible to enter.
How to Enter
Complete the online nomination form.
Entrants must nominate a local kindergarten, school, charity, community group, not-for-profit organisation, specialist centre or other community organisation (Nominated Organisation) within Australia that is legally able and willing to receive the Donation Product.
One nomination per organisation per entrant.
Donation Product
Ten (10) cubby houses are available nationally as donation products.
Two (2) cubby houses will be allocated per participating state.
If selected by Dulux, the Donation Product will be provided to the successful Nominated Organisation, not to the entrant.
The Donation Product is not transferable, exchangeable or redeemable for cash or any other alternative and must be accepted as awarded.
The Promoter may, in its discretion, substitute a Donation Product with another product of equal or greater value if the advertised Donation Product is unavailable, unsuitable, unsafe, impractical to deliver, or otherwise cannot reasonably be provided.
The Promoter is not responsible for any ancillary costs associated with accepting, transporting, installing, applying, maintaining or using the Donation Product unless expressly stated in these Terms and Conditions.
Assessment and Selection of Donation Recipients
Nominations will be assessed by Dulux or a panel appointed by Dulux.
In assessing nominations, Dulux may consider factors including community impact, need, suitability, logistical feasibility, safety, reputational considerations and benefit to local children and families.
Dulux retains ultimate discretion to determine donation recipients and its decision is final.
This promotion is intended to facilitate community nominations for potential donations by Dulux. Entrants are not competing to win a prize for themselves, and no prize, payment or other benefit is awarded to entrants.
A nomination does not create any right or entitlement for the entrant or Nominated Organisation to receive a Donation Product, and the Promoter is not contractually bound to provide a Donation Product to any nominated entity.
The Promoter retains ultimate discretion to determine whether a nominated organisation is eligible, appropriate, suitable and able to receive the Donation Product, having regard to factors including community impact, need, suitability, reputation, logistics, safety and the benefit to local children and families.
The Promoter may reject any nomination, withhold a Donation Product or select an alternative recipient where the nominated organisation is ineligible, inappropriate, controversial, reputationally sensitive, unable to receive the goods, unable to be verified, unable to be contacted, declines the donation, or does not complete any documentation reasonably required by the Promoter.
Any public voting or community support mechanism is intended to assist Dulux to understand community interest only. Public votes, nominations or community support are not determinative and do not determine the recipient of any Donation Product.
Notification
Successful Nominated Organisations will be contacted by phone and/or email.
If a successful Nominated Organisation cannot be contacted or declines the Donation Product, Dulux reserves the right to select an alternative recipient.
Before providing the Donation Product, Dulux may require the Nominated Organisation to confirm its legal name, ABN or registration details, charitable or not-for-profit status where relevant, delivery address, contact person, authority to accept the Donation Product, and ability to safely receive and use the Donation Product.
Delivery
The Donation Product will be donated in their existing condition as displayed or otherwise described, subject to availability and any reasonable substitution determined by Dulux.
Successful Nominated Organisations must be able to accept delivery or collection within the timeframe specified by Dulux.
Risk in the Donation Product passes to the successful Nominated Organisation on delivery or collection. To the maximum extent permitted by law, Dulux is not responsible for installation, assembly, application, use, supervision, storage, suitability for purpose, ongoing maintenance, repairs, insurance, permits, compliance with site requirements or any damage, loss or injury arising after delivery or collection.
The successful Nominated Organisation is responsible for assessing whether the Donation Product is suitable for its premises, users and intended use and for obtaining any consents, approvals, permissions or insurance required to accept, install, display, maintain or use the Donation Product.
Use of Information
By entering, entrants consent to Dulux contacting them regarding the promotion.
Entrants confirm they have authority to provide information about the nominated organisation.
Entrants warrant that they have obtained all permissions reasonably required to provide the Nominated Organisation’s name, contact details and other information to Dulux and that the information provided is true, complete and not misleading.
By participating, entrants consent to Dulux contacting the Nominated Organisation to verify the nomination, confirm eligibility and obtain any consents or information required in connection with the donation.
Personal information will be handled in accordance with the Dulux Privacy Policy.
Publicity
By accepting a Donation Product, the successful Nominated Organisation consents to Dulux using its name, suburb, images, nomination story and details of the donation for promotional, marketing, public relations and publicity purposes without additional compensation, unless prohibited by law. Dulux may require a separate publicity release or consent form before publicising the donation.
Where any children, staff, volunteers or other individuals are photographed, filmed or otherwise identified in connection with the donation, the successful Nominated Organisation must ensure all necessary consents have been obtained before those materials are provided to or used by Dulux.
General
Dulux reserves the right to verify entries and disqualify incomplete, misleading or fraudulent nominations.
Dulux may verify the identity, eligibility, legitimacy, registration status, authority and suitability of any entrant or Nominated Organisation and may require evidence reasonably satisfactory to Dulux before confirming any recipient.
Dulux may refuse to provide, or may withdraw, a Donation Product where it reasonably considers that doing so may breach any law, create a safety, reputational, operational or logistical risk, conflict with Dulux’s values or policies, or associate Dulux with an organisation or cause that Dulux considers inappropriate or controversial.
Any tax liability, reporting obligation, duty, fee, levy, cost or other consequence arising from receipt, acceptance or use of a Donation Product is the responsibility of the recipient organisation. Entrants and recipient organisations should obtain their own independent advice about any tax or accounting implications.
Dulux may amend, suspend or cancel the promotion if circumstances outside its reasonable control prevent it from proceeding as planned.
Dulux’s decision regarding eligibility, suitability, verification and selection of any donation recipient is final.
Nothing in these Terms and Conditions limits, excludes or modifies any statutory consumer guarantee, right or remedy that cannot lawfully be limited, excluded or modified.
