PART A - GENERAL TERMS 1.Business +Plus 1.1 Business +Plus is provided by DuluxGroup (Australia) Pty Ltd (ACN 000 049 427) of 1956 Dandenong Rd, Clayton, Victoria 3168, Australia (We or Us) at www.dulux.com.au. 1.2 These Terms set out the terms and conditions on which you (You) may access and use Business +Plus. These Terms apply in addition to any other terms and conditions to which You are subject in relation to Business +Plus, including: a. Your trade account agreement with Us (if you are a trades person) (Trade Account); b. the terms of use for Our website at http://www.dulux.com.au; (the Website);c. the privacy policy at the Website (Privacy Policy); and d. any relevant third party terms and conditions, including My Account payment and rewards program terms,(collectively, Other Terms). In the event of any inconsistency between these Terms and the Other Terms, these Terms will prevail to the extent of the inconsistency.1.3 By accessing and using Business +Plus, You accept and agree to these Terms (and any applicable Other Terms) without any limitation or qualification. These Terms constitute a legally binding agreement between You and Us. 1.4 We may change these Terms from time to time by posting the changed Terms on Business +Plus. By You continuing to use Business +Plus, such changed Terms will apply from that point forward.1.5 You warrant to Us that You have the authority to enter into an agreement with Us on these Terms.1.6 While We have undertaken reasonable steps to ensure that the information on Business +Plus is accurate and free from defect, the information may at times be out of date or include omissions, inaccuracies or other errors, for which we are not responsible.1.7 Since electronic services are subject to interruption and breakdown, access to Business +Plus is offered on an ‘as is’ and ‘as available’ basis only. 2. Logging in2.1 Business +Plus is only accessible to You if You have “logged in” by providing Your username and password on the log-in and/or authentication page of Business +Plus (this information is your Login).2.2 You must not provide details of your Login to any other person. You must not allow any other person to use your Login.2.3 You acknowledge that You are solely responsible for all activity that occurs on Your account / under Your Login.3. Termination3.1 You may stop using Business +Plus at any time for any reason, without notice to Us. We may terminate, disable, block or suspend Your access to Business +Plus:a. immediately, if You breach, or We suspect on reasonable grounds that You have breached, these Terms or any Other Terms; or b. on 7 days’ notice to You, at any other time for any other reason.4.General responsibilities4.1 You are responsible for: a. all of Your activity on and in connection with Business +Plus; b. all of the content and details that You submit into Business +Plus; and c. what you access on Business +Plus, how You interpret or use Business +Plus and any actions You may take as a result of Business +Plus.4.2 You may not use personal information about another person that You obtain from using the Find a Painter function of Business +Plus, other than for the purposes described in clause 17. 4.3 You may not use Business +Plus outside of Australia.5. Privacy5.1 We may collect personal information including Your name, contact details and details of your interactions with Us and Business +Plus. If You are a trades person and You have a current Trade Account, We may combine Your Trade Account information with information We collect in connection with Business +Plus.5.2 We may collect, use and disclose Your personal information to (1) provide, administer, improve and personalise Business +Plus and Our products and services; (2) process payments and refunds; (3) identify You; (4) maintain and update Our records; (5) conduct product and market research; (6) protect Our lawful interests; and (7) deal with Your concerns. We may not be able to do these things without Your personal information. For example, the functionality of Business +Plus may be limited. 5.3 If you are a trades person, You acknowledge and agree that users of Business +Plus may be located in other countries when they access the Find a Painter tool (described below in clause 17) and in such circumstances Your personal information may be disclosed by Us outside Australia. 5.4 We may provide marketing communications and targeted advertising to You on an ongoing basis by electronic messages (eg. email and SMS), online (including websites and mobile apps), telephone and other means, unless You opt out or We are subject to legal restrictions. To opt out, simply follow the unsubscribe link or prompts in the communication, advise the caller or contact us directly. 5.5 We may exchange Your personal information with Our related bodies corporate and with Our service providers (including Westpac and the administrator of our Dulux Rewards Program) that assist us with archival, auditing, accounting, customer contact, legal, business consulting, banking, payment, delivery, data processing, data analysis, information broking, research, investigation, website or technology services. 5.6 Subject to this clause 5, We may also handle personal information as set out in the Privacy Policy which is available online or by contacting Us. You acknowledge that You have read the Privacy Policy and understand that it contains further details about Our handling of personal information, procedures regarding access and correction of personal information and Your privacy concerns. 5.7 If You provide personal information to Us (including by inputting it into Business +Plus) about any third party, You must first ensure that they consent having regard to this clause 5 (as though it extended to them) and the Privacy Policy (subject to this clause 5). 6 Links to third party websites6.1 Business +Plus may contain links to other websites or applications owned, operated or produced by third party organisations independent of Us (Third Party Sites). The links are provided for convenience only and We have not verified and do not sponsor, endorse or approve the operators of, or any materials on (including information, products or services), those Third Party Sites. 7 Third party tools 7.1 Certain tools, devices, software programs or other features (Tools) available on or through Business +Plus may be provided by third parties. These Tools are not Our Tools and are provided or made available as a convenience to You. These Tools are not operated by Us and We are not responsible for examining or evaluating the content, availability, accuracy, adequacy, timeliness, validity, copyright compliance, legality, decency, quality, completeness or any other aspect of these Tools.8 Your consumer rights8.1 Nothing in these Terms is intended to exclude, restrict or modify rights which You may have under any law (including the Australian Consumer Law) which may not be excluded, restricted or modified by agreement (Your Consumer Rights). You can find out more about Your Consumer Rights from consumer organisations and bodies such as the Australian Competition and Consumer Commission and State/Territory fair trading authorities.8.2 If You suffer any loss in connection with Business +Plus, You must take all reasonable steps to minimise your loss, including notifying Us without delay if there are steps We can take to help minimise Your loss.8.3 Subject to Your Consumer Rights, we are not liable:a. for any loss that was not reasonably foreseeable to You and Us; andb. to the extent that Your loss was contributed to by You or any other matter outside of Our reasonable control.9 General 9.1 These Terms are governed by the laws of Victoria, Australia. The courts of Victoria, Australia (and the courts of appeal from them) have exclusive jurisdiction to resolve any disputes arising under or in connection with these Terms.9.2 If You have any questions or complaints about Business +Plus, please contact Us on the details below:9.3 Telephone number: 13 23 779.4 Email address: dulux.customer.service@dulux.com.auPART B - BUSINESS +PLUS 10. General Business +Plus Eligibility 10.1 In order to access Business +Plus and its functions, You must at all times hold a valid trading account with Us.11 Job Leads Eligibility11.1 Where You are not a Dulux Accredited painter, You must pay an annual administration fee in order be eligible to use the Job Leads area of Business +Plus.11.2 You warrant to Us that, at all times when using Job Leads on Business +Plus: a. You hold a current and valid contractor’s licence; and b. You have and will maintain public liability insurance at the level required by law or such other level as determined by Us at our sole discretion. 12 Online ordering 12.1 You may access the Ordering section of Business +Plus by following the visual and text prompts in Business +Plus. In the Ordering section, You may order:a. paint; andb. paint accessories,(together, the Products). 12.2 When you access the Ordering section:a. prices for paint will not be displayed (these will be calculated for You after You place Your order in accordance with the terms of, and the discounts applicable to, Your Trade Account); andb. prices for paint accessories will be displayed. 12.3 After Your order has been processed through Dulux’s EPOS system, You will receive an invoice from Us with the details of your order in accordance with the terms of Your Trade Account, as well as being available on My Account.12.4 Your order of Products will also be governed by the terms of Your Trade Account.13 Receiving Your Products13.1 If You change Your mind about Your order, You may cancel it without charge prior to your nominated pick up or delivery date. You can do this by contacting your nominated Dulux Trade Outlet. 13.2 You will be prompted to select from the following two options to obtain Your Products: a. Delivery: If You select delivery, the Products will be delivered to the address that You specify in accordance with Our Delivery Policy (refer to your Trading Account terms and conditions). b. Store pick up: If You select store pick up, Your Products will be available to be collected by You from the date and time stated on your order confirmation. Your order will be available from the store selected by You.13.3 Our Returns Policy (refer to your Trading Account terms and conditions) applies to all purchases on Business +Plus. 14 My Account14.1 My Account enables You to view and manage the invoicing and payments for Your Trade Account with Us. 14.2 When You log in to My Account, You can:a. view, download and pay outstanding invoices; b. send a copy of the receipt to Your nominated email address; c. view and download current and past statements; d. view credits available; and e. log queries or disputes (which Our customer team will follow up with You),in relation to Your Trade Account. 14.3 All payments of invoices on My Account must be made by the following permitted credit cards: American Express, Visa or MasterCard. 14.4 Prices shown on Your invoices are in Australian dollars and include GST where applicable. 14.5 You acknowledge that Your invoice is generated based on, and You will receive Your order in accordance with, the information that You input into the Trade Hub.15 Rewards program 15.1 If you are a member of the Dulux Rewards Program, You may manage Your rewards through the Business +Plus. 15.2 The Dulux Rewards Program is operated through a third party-provided rewards portal (the Rewards Portal). You must comply with the third party terms and conditions applicable to the Rewards Portal available at https://rewards.dulux.com.au/public/info.aspx?name=terms.15.3 On the Rewards Portal, You may redeem Dulux reward points to acquire goods and services listed from time to time in the Dulux Rewards Program catalogue.16 Special offers and promotionsBusiness +Plus may also contain links to various special offers and promotions available exclusively to Dulux trade members from various third party product and service providers (Special Offers). These Special Offers are subject to separate terms and conditions found by following the relevant link or otherwise provided by the relevant third party.PART C - FIND A PAINTER 17 The Terms in this Part C apply if You are a consumer. 17.1 In the Find a Painter area of the Dulux website, You may follow the prompts to submit the following Job Details:a Your postcode;b Your property type, including the number of stories in Your property; c whether the paint job is new or a repaint;d job size;e job type; andf whether wallpaper, decking or roof services are required,and Your email, first name, last name, phone, address and suburb (Your Personal Details). 17.2 Once You have submitted Your Job Details and Your Personal Details, Find a Painter will load a list of painters who may be suitable to perform Your job based on the Job Details and Personal Details submitted by You. 17.3 On or before a painter is included in the Find a Painter database, they will be checked by a third party to confirm that they are licensed in the relevant Australian State and hold the minimum amount of insurance required by law. 17.4 Find a Painter will identify, by displaying the logos next to each painter’s name, whether the listed painter is:a. a Dulux Accredited Painter, that is, a painter who:a.1 is selected by Us based on Our recruitment criteria including workmanship and reliability; a.2 uses Our premium paints; anda.3 has signed Our ethical and professional standards document.b. Independently validated by EBIX Trades monitor, and/orc. a member of the ‘Master Painters Association’ (MPA) (see http://www.mpav.com.au/). 17.5 We are not involved in or responsible for the accreditation, assessment or monitoring of EBIX or MPA members or memberships. 17.6 If You:a. select one or more of the listed painters, and b. click on the ‘Email me details’ functionality, the Find a Painter service will send an email to Your nominated email address with the phone number and email of the painter or painters selected by You.18 Your Responsibilities18.1 You acknowledge and agree that the results generated by Find a Painter are generated based on the Job Details and Personal Details that You input into the Find a Painter service and may be out of date or include omissions, inaccuracies or other errors, for which we are not responsible. 18.2 If You engage a painter that You find through Find a Painter, that engagement is entered into directly between You and the relevant painter only. You must separately discuss and negotiate that engagement. We are not responsible for any aspect of that engagement or job, including without limitation in relation to price, timeframe and quality.18.3 It is Your responsibility to make appropriate enquiries and satisfy Yourself in relation to the suitability of:a. the painter (including in relation to whether the painter is a Dulux Accredited Painter, an MPA member or an EBIX member);b. the paint to be used;c. the pricing; d. the timeframe; e. the overall job description;f. the quality; and g. any other necessary details, for Your paint job.

1. Introduction1.1 The Rules of Membership explain the terms and conditions of the Dulux Rewards Program.1.2 From time to time Dulux may vary The Rules of Membership without prior notification. Dulux will provide Members with 30 days notification of material changes to the Terms and Conditions on the Rewards Website.1.3 The use of the Dulux Trading Account shall constitute acceptance of the Rules of Membership.2. Dulux Rewards Membership and Fees2.1 Customers, other than Commercial Customers, with a Dulux Trading Account may apply to participate in the Dulux Rewards Program.2.2 All Members must pay the Membership Fee annually. Customers will be charged annually on their accounts. The Membership Fee may be waived from time to time, at the discretion of Dulux. There are no monthly administration charges.2.3 Members are not entitled to transfer their Membership to any person, entity or account.2.4 Cancellation of a Member's Dulux Trading Account also constitutes cancellation of that Member's membership of the Dulux Rewards Program.2.5 Dulux intends to use Members' details for marketing purposes from time to time. Generally, Dulux will only disclose this information to organisations which help to supply or promote Dulux goods or services and to other companies in the Dulux group. Customers may access information Dulux holds about them or obtain a copy of the Dulux privacy policy by visiting dulux.com.au/trade or by contacting the Dulux Customer Service on 13 23 77. Any Member who does not wish to receive marketing information should send a written request to Dulux Rewards Program Manager, Dulux Rewards Program, Reply Paid 60, Clayton South, VIC 3169 to be removed from such mailing lists.3. Earning Dulux Rewards Points3.1 Members will accumulate Dulux Rewards Points by purchasing and paying for Products from Dulux Trade Outlets and Dulux Customer Service.Dulux Rewards Points will accumulate based on the value of Products purchased and paid for using the Dulux Trading Account. Points will accrue as follows:a. six Dulux Rewards Points will be accrued for each dollar spent on Dulux premium household decorative paint (excluding Dulux Professional) and Envirosolutions products;b. one Dulux Rewards Point will be accrued for each dollar spent on Berger Gold Label and Hadrian Contractor; andc. three Dulux Rewards Points will be accrued for each dollar spent on any other purchases.3.2 Dulux may offer Bonus Points to Members from time to time at Dulux's absolute discretion.Dulux Rewards Points will not accumulate for bank fees, government fees and charges, taxes or interest charges incurred on the Dulux Trading Account or purchases for which a refund is subsequently obtained.3.3 Dulux will issue a monthly trading Account Statement to customers.3.4 In order to earn Dulux Rewards Points, payments must be received by Dulux no later than the due date on the Account Statement. Payment in full is required.3.5 Dulux reserves the right to adjust a Member's total Dulux Rewards Points if points have been incorrectly credited or debited for any reason.3.6 Dulux may, at its absolute discretion, withhold Dulux Rewards Points at any time. If the Member is in breach of trading terms, Dulux may withdraw or cancel the value of any rewards from the Member's balance. Dulux shall not be liable for any loss or damage suffered resulting from withholding, cancellation or withdrawals made by Dulux in accordance with these Rules of Membership.4. Allocation of Dulux Rewards Points4.1 The Member will be allocated Dulux Rewards Points on payment of the Account Statement in accordance clause 3.6.4.2 Dulux will make available to each Member, via the Dulux Rewards Website, a Rewards Statement identifying the number of Dulux Rewards Points accumulated by the Member.4.3 A Rewards Statement will be emailed to each Member at least once per year. Additional mailings of the Rewards Statement may be made at Dulux's discretion.4.4 Members will have up to 30 days from the Rewards Statement date to dispute and seek adjustment of the Dulux Rewards Points balance shown on their Rewards Statement. After the expiry of the 30 day period, the Rewards Statement will be deemed correct.5. Redemption of Dulux Rewards Points 5.1 Members may redeem Dulux Rewards Points in order to acquire Rewards.5.2 The value of each Reward will be stated in Dulux Rewards Points. The value of each Reward will include where applicable any freight costs incurred to deliver the Reward to your nominated destination during normal business hours. All disputes regarding the redemption of Rewards will be resolved by Dulux and Dulux's decision will be final and binding.5.3 Members wishing to redeem Dulux Rewards Points may do so by:a. accessing the Dulux Rewards Website; orb. by contacting Dulux Customer Service on 13 23 77All requests for redemptions must comply with security and identification procedures notified to Member by Dulux from time to time.5.4 Dulux has the right, in its absolute discretion, to make any changes to the types of Rewards offered or to the number of Dulux Rewards Points required to redeem Rewards. Any such changes will be set out in the Dulux Rewards Website.5.5 Dulux will not be responsible for any loss caused as the result of any Rewards having been exhausted or being no longer available to Members.5.6 Dulux will not be responsible for any loss caused to a Member as the result of the fraudulent redemption of Dulux Rewards Points by an unauthorised person(s) where such redemption has been accepted on the basis of the security and identification procedures applicable from time to time.5.7 Dulux Rewards Points are not redeemable for cash.5.8 Redeemed Rewards may not be exchanged for other Rewards and are not refundable, replaceable or transferable for cash or credit.5.9 If a Member has insufficient Dulux Rewards Points to redeem a particular Reward, the Member may purchase the remaining Dulux Rewards Points required. Dulux reserves the right to determine the cost of the remaining Dulux Rewards Points required to redeem the Rewards at its absolute discretion.5.10 A Member may only purchase the remaining Dulux Rewards Points via the Points Plus Pay functionality on the Dulux Rewards Website. Payment must be made with a credit card. The redemption and payment process must comply with security and identification procedures applicable from time to time.5.11 Dulux Rewards Points are not transferable to other Members.5.12 Dulux Rewards Points remain valid for a period of 2 years from the date they are first credited on the Rewards Statement, after which time they will be forfeited.5.13 If a Member has failed to accrue additional Dulux Rewards points during a consecutive 12 month period, Dulux has the right to forfeit all points accrued by that Member.6. Termination6.1 If a Member has failed to make the minimum payment specified on any Account Statement by the due date Dulux may, at its absolute discretion suspend or cancel a Dulux Trading Account and the Membership of the Dulux Rewards Program.6.2 A Member will not be able to redeem Dulux Rewards Points whilst the Dulux Account is suspended.6.3 If a Dulux Account and Membership of the Dulux Rewards Program is cancelled by Dulux, all monies owing to Dulux shall immediately become due and payable, and any unredeemed Dulux Rewards Points are immediately forfeited.6.4 A Member may cancel their Dulux Trading Account and Membership of Dulux Rewards Program by giving not less than 30 days' notice in writing to Dulux.6.5 If a Member elects to cancel their Dulux Trading Account and Membership of the Dulux Rewards Program, the Member shall have 90 days from the date of cancellation to redeem their Dulux Rewards Points. After 90 days, all Dulux Rewards Points shall be forfeited.6.6 Termination of the Program Dulux reserves the right to suspend, withdraw or terminate the Program at any time in its absolute discretion, and may, where practicable give reasonable notice to the Member. If Dulux Rewards is terminated, Members must redeem any unredeemed Dulux Rewards Points within three (3) months of the termination of the Program.7. TaxIt is the responsibility of the Member to seek independent professional taxation advice in relation to the taxation effects arising from Membership of and participation in Dulux Rewards. In addition, the Member is responsible for any taxation liability (including but not limited to GST) or any applicable fringe benefits tax or other government fees, taxes, impositions and charges relating to its Membership or the redemption of any Rewards.8. General Provisions8.1 The liability of Dulux and the Dulux Rewards Program Manager for breach of a condition, whether expressed or implied in the Rules of Membership by law, is limited to any one of the following as determined by Dulux:a. the replacement of Rewards or Products or the supply of equivalent Rewards or Products; orb. the repair of the Rewards or Products or the payment of the cost of having the Products or Rewards repaired.8.2 To the extent the law permits and notwithstanding any other clause of these Rules of Membership, Dulux and the Dulux Rewards Program Manager exclude all liability whatsoever to the Member arising out of or in any way connected with the Dulux Rewards Program for any consequential or indirect losses of any kind howsoever arising and whether caused by a breach of statute, breach of contract, negligence or other tort. Consequential or indirect losses will be taken to include but not limited to:c. any loss of income, profit or business;d. any loss in the nature of overhead costs; ande. any loss of goodwill or reputation.8.3 The Rules of Membership are governed in accordance with the laws of Victoria, Australia.8.4 Dulux reserves the right to change the Reward Point Value of catalogue items without any notice.8.5 Dulux reserves the right at their absolute discretion at any time to exclude any customer from inclusion in the Reward Program or to cancel the registration of any customer.8.6 To the extent permitted by law, Dulux is not responsible for Rewards received under a Rewards Program, any death or injury, loss or consequential loss or damage arising from, in connection with or caused by a Reward, or the loss, theft or destruction of a Reward or a Reward voucher.8.7 To the extent permitted by law, Dulux provides no warranty with respect to the quality of the Rewards or their acceptability or fitness for any purpose.8.8 Any dispute concerning goods or services received as a Reward shall be settled between the Member and Rewards Provider who supplied the goods or services.8.9 Failure to enforce a particular term or condition of these Terms and Conditions does not constitute a waiver of that term or condition by Dulux.8.10 Dulux may exercise any right, power or remedy in this document at its discretion and separately or concurrently with any other right, power or remedy.9. DefinitionsAccount Statement means the summary of the previous month's purchases from Dulux using your Dulux Trading Account.Bonus Points means extra Dulux Rewards Points awarded to Members, in addition to the points as described in clause 3.2.Commercial Customer means a large customer classified by Dulux sales representatives as a commercial customer.Dulux we or us, means DuluxGroup (Australia) Pty Ltd ABN 67 000 049 427, whose registered office is located at 1956 Dandenong Road, Clayton VIC 3168, Australia.Dulux Customer Service means the call centre operated by Dulux. The call centre can be contacted by telephone on 13 23 77.Dulux Rewards Points means the points allocated to Members in accordance with the Rules of Membership and which may be redeemed for Rewards.Dulux Rewards Program means the scheme offered by Dulux which provides Dulux Rewards Points to Members for the purchase of Products using their Dulux Trading Account.Dulux Rewards Website means the Dulux Rewards website, which is accessible at from www.dulux.com.au/tradeDulux Trading Account means a standard 30 day credit account issued by Dulux.Dulux Trade Outlets means Dulux trade centres and depots and any other stores notified to Members from time to time by Dulux.Member means a customer accepted for membership of the Dulux Rewards Program and who holds a Dulux Trading Account.Membership Fee means an annual fee for membership of the Dulux Rewards Program as notified in writing by Dulux to the Members from time to time.Dulux Financial Year means the period from 1 October in a given calendar year until 30 September in the following calendar year.Points Plus Pay means a method by which Members can use a valid credit card to pay for the remainder of a Reward where they have insufficient points or where they do not wish to spend all their Dulux Rewards Points to redeem a reward.Product(s) means all goods available for purchase from Dulux Trade Outlets or Dulux Customer Service.Rewards means goods and services listed from time to time in the Dulux Rewards Program catalogue.Rewards Statement means a statement setting out Dulux Rewards Points' information.Rules of Membership means these terms and conditions governing the Dulux Rewards Program.

Dulux Business Plus Jobs Leads Terms & Conditions 2014

Job Leads Eligibility.  Where You are not a Dulux Accredited painter, You must pay an annual administration fee in order be eligible to use the Job Leads area of Business +Plus. You warrant to Us that, at all times when using Job Leads on Business +Plus: You hold a current and valid contractor’s licence; and You have and will maintain public liability insurance at the level required by law or such other level as determined by Us at our sole discretion.

I agree to all terms and conditions of service, including the annual administration fee of $56 (ex gst), which will be charged to my Dulux Trade Account. A one-off fee of $56 (ex gst) will be charged regardless of the outcome of my application.
